WARRANTY OF GLASS FIBER POOLS

GUARANTEE:

P.H.U. ANITA / POOL SHOP (i.e. PHU ANITA IMPORT-EXPORT ANITA PIŁAT, NIP/VAT: 9591634510, ul. Radomska 41, 26-634 Gózd – further on referred to as „P.H.U. ANITA / POOL SHOP”, “Guarantor”, “Manufacturer”) provides a 10-year guarantee on the construction of the pool (pool basin) and a 20-year guarantee on the watertightness of the pool (pool basin).

P.H.U. ANITA / POOL SHOP warrants to the customer – the end-user who has made the purchase – that the swimming pools (swimming pool basins) are free from defects in materials and manufacturing errors in the construction and tightness of the swimming pool (swimming pool basin) during the above-mentioned warranty periods, which start from the date of purchase.

ENTITLED UNDER THE GUARANTEE:

The person entitled under the guarantee is the Customer – an individual (consumer) who has purchased a swimming pool (pool basin) from the Manufacturer.

GUARANTEE CONDITIONS:

The condition for exercising the guarantee rights is:

  • possession by the customer of a document confirming the purchase of the swimming pool (pool basin);
  • carrying out the installation of the pool (swimming pool basin) in accordance with the regulations in force and the manufacturer’s recommendations contained in the instructions for use, installation, operation and this guarantee, with additional conditions depending on the contractor for the installation of the pool (swimming pool basin):
  1. in the case of the installation of a swimming pool (pool basin) by the Manufacturer – the possession by the Customer of a confirmation of the installation in the form of an acceptance certificate;
  2. in the case of the installation of a swimming pool (pool basin) by the Customer, the possession by the Customer of photographic documentation of the unloading of the pool (pool basin) and the overall installation of the pool (pool basin) and the execution of the installation in accordance with the Manufacturer’s recommendations;
  • use and operation of the pool (swimming pool basin) in accordance with the regulations in force and the Manufacturer’s recommendations contained in the instructions for use, installation, operation and this guarantee;
  • notification to the Guarantor of a defect covered by the guarantee, stating the Customer’s data, date of purchase, date of installation of the pool (pool basin), installation address of the pool (pool basin), description of the defect in the pool (pool basin), information on the time when the defect occurred and was detected, type of defect, photographs illustrating the defect (e.g. leak, crack, leak, etc.). Notification should be made in writing to the Guarantor’s address during the guarantee period, no later than the last day of the guarantee period.

The guarantee is valid in every country to which the Manufacturer delivers its goods. The guarantee is only valid with proof of purchase.

MANUFACTURER’S RECOMMENDATIONS FOR CONTROLLING THE OPERATION OF THE POOL:

The guarantee covers defects or faults that arise during the guarantee period with proper use and operation of the swimming pool (pool basin). A prerequisite for exercising rights under the guarantee is that the customer keeps and maintains records of the use parameters of the pool water during the guarantee period. The Customer should perform a constant inspection, check and record at least once a week, noting the date and the read value of the following parameters:

  • pH value (*) of the water in the pool (swimming pool basin). PH should be between 7.0-7.4.
  • free chlorine value (*) in swimming pool water. Free chlorine should be between 0.5-1.0;
  • temperature of the water in the pool (swimming pool basin). The water temperature in the pool should not exceed 30 degrees Celsius.

(*) the above does not apply to customers with a salt chlorinator or automatic dosing of chlorine and PH

The performance parameters indicated above should be tested by the customer using approved testers and reagents in the form of, for example, PH or free chlorine reading tablets (so-called DPD1).

The Guarantor reserves the right to refuse to consider a guarantee claim if the Customer does not have documentation with records of readings of water parameters in the pool (swimming pool basin).

MANUFACTURER’S RECOMMENDATIONS FOR THE INSTALLATION OF THE POOL:

The guarantee covers defects or faults that arise during the guarantee period with the correct installation of the pool (pool basin). The condition for exercising guarantee rights is that the installation is carried out by the Manufacturer or by the Customer.

In the case of installation by the customer, the installation must be carried out in accordance with the Manufacturer’s instructions and only by specialised operators (companies) or persons in the pool, heating and plumbing sectors with the relevant qualifications and professional experience, and in the case of electrical installations and connections, they must be carried out by authorised electrical contractors. In addition, the customer should make and have in his possession photographic documentation of the unloading of the pool (pool basin) and the installation of the pool (pool basin).

The Guarantor reserves the right to refuse to consider a guarantee claim if the Customer does not have the documentation from the installation of the pool (pool basin).

MANUFACTURER’S RECOMMENDATIONS FOR USE OF THE POOL:

The guarantee covers defects or faults that arise during the guarantee period with proper use and operation of the swimming pool (pool basin). The prerequisite for exercising guarantee rights is to use the pool in accordance with its intended use. Swimming pools (pool basins) and their accessories are designed for use as swimming pools and swimming pools. The swimming pool (pool basin) and its equipment is designed for use when filled with water. The Guarantor reserves the right to refuse to consider a guarantee claim if the Customer uses the pool (pool basin) contrary to its intended use.

The correct use and operation of the swimming pool (pool basin) should involve the Customer performing regular activities, at least once a week, in the form of:

  • inspect the pool (swimming pool basin) for its integrity and the condition of its surface;
  • control of swimming pool (pool basin) water parameters, at least the free chlorine value, PH value and water temperature;
  • mechanical cleaning of the pool (pool basin) with a soft cloth or brush (perimeter and wall surface above the water table);
  • mechanical cleaning of the walls and bottom of the pool (swimming pool basin) using pool cleaning equipment in the form of approved waste removal brushes or pool hoovers;
  • chemical disinfection of the pool (swimming pool basin) with agents designed for cleaning swimming pools and in the appropriate recommended dosages;
  • inspection of the technical room (engine room), where the pool technology with its accessories (e.g. water filter, pool pump, etc.) is installed;
  • checking drainage patency and operation of drainage pumps;
  • checking the pre-filters in the pool (skimmer) and pool pump (basket);
  • checking the operating pressure of the water filter and its operation;
  • control of the correct operation of pool equipment and accessories affecting the quality of the water in the pool (pool basin).

The customer should pay particular attention to the following conditions which may affect the condition of the pool surface (pool basin) and which may cause damage not covered by the Manufacturer’s guarantee:

  • high iron values in the water can cause corrosion on built-in parts and equipment or deposit on the walls of the pool (swimming pool basin);
  • high water hardness can cause a rough build-up on the walls of the pool (pool basin), which can discolour its surface.
  • the high temperature of the water in the pool (pool basin) can cause discolouration of its surface. The water temperature must not exceed 30°C.

The customer is obliged to have the pool (swimming pool basin) serviced a minimum of two times per year by an authorised pool company.

GUARANTEE EXCLUSIONS

The manufacturer’s guarantee does not cover damage, defects, faults which have arisen or may have arisen as a result of incorrect installation, operation or use of the pool (pool basin), and in particular caused by:

  • incorrect installation of the pool (pool basin) which was carried out in breach of the instructions and recommendations of the Manufacturer;
  • the use of water of poor quality to fill a swimming pool (pool basin), in particular taken from sources such as a hydrant, wells, lakes, ponds, rivers, etc.;
  • the use of unsuitable cleaning products or the overuse of swimming pool chemicals, particularly as a result of an overdose of chlorine values;
  • repair, renovation or servicing of the swimming pool (pool basin) carried out by unauthorised persons other than the Manufacturer;
  • repair, renovation or servicing of pool equipment affecting the operation of the pool (pool basin) carried out by unauthorised persons;
  • overheating of the water in the pool (pool basin) above 30 degrees Celsius;
  • mechanical damage to the pool (pool basin), including scratches, discolouration, cracks caused by mechanical factors such as sand, tree resin, bird droppings, contamination caused by other corrosive factors, human or animal action;
  • failure to maintain an adequate water level in the pool (pool basin):
    1. during the summer period, filling with water to a height of 1/2 of the skimmer hole cover;
    2. during the winter period, filling with water up to 3/4 of the total volume or approx. 10 cm below the light line in the pool (pool basin);
    3. filling up to three quarters of the total volume with water in summer and winter if there is high groundwater at the pool site;
  • defects in the installation to which the pool (pool basin) is connected;
  • by atmospheric conditions, catastrophe, slipping and movement of the earth, lightning strike, fire, vandalism, unauthorised or incorrect installation of swimming pool (pool basin) accessories that have not been approved by the Manufacturer;
  • use of the pool (swimming pool basin) in contravention of the instructions or recommendations of the Manufacturer;

The guarantee does not apply to pools (swimming pool shells) from sales, promotional campaigns, incomplete (second quality), discounted or so-called bonus pools.

Unusual colour shades made to individual customer specifications are not covered by the guarantee. Standard colours according to the Manufacturer are light blue and white.

The products that are bound to or fitted into the pool (pool basin) such as lamp bulbs, UV lamp bulbs, thermometers, manometers, components that are subject to normal wear during operation such as rubber seals, sealants, rotating components e.g. rotors, bearings are not covered by the guarantee.

The guarantor is relieved of its guarantee obligations if the required repairs cannot be carried out due to import or export restrictions on spare parts or materials necessary for repairs or other legal provisions.

The warranty does not cover  technical boxes, including damage to products that are connected to or installed in these boxes and damage, defects, faults that occurred or could have occurred as a result of improper installation, operation or use of the boxes and products located therein.

GUARANTEE APPLICATIONS:

Guarantee claims relating to the construction of the pool (pool basin) and the tightness of the pool (pool basin) should be made in writing by the Customer to the Guarantor at the address: PHU ANITA IMPORT-EXPORT ANITA PIŁAT, NIP/VAT: 9591634510, ul. Radomska 41, 26-634 Gózd.

In the application the customer should state:

  • personal and contact details, at least: name, mailing address, telephone number and/or e-mail address;
  • the date of purchase of the pool (pool basin);
  • date of installation of the swimming pool (pool basin);
  • swimming pool (pool basin) installation address;
  • a description of the fault in the pool (swimming pool basin), including information on when the fault occurred and was detected, and the type of fault (e.g. leak, crack, leak, etc.)
  • photographs showing the defect (e.g. leak, crack, leak, etc.).

Photographic documentation should be made when the pool is filled with water. Entries are also verified in a pool (pool basin) filled with water. Any defects or faults in the pool (pool basin) will be rectified free of charge during the guarantee period if they are caused by a material or production fault.

In the event of a guarantee claim, the customer can turn with the proof of purchase to the dealer, salesman or directly to the Manufacturer’s head office, which will expedite the handling of the claim.

Handling of a guarantee claim:

  1. If the Guarantor is informed of defects or faults in a swimming pool (pool basin) covered by the guarantee, it will be repaired or replaced with a new one, but the Guarantor reserves the right to decide on its own how the defect or fault should be removed so as to restore the swimming pool (pool basin) to its original condition, not interfering in any way with its use.
  2. The Guarantor undertakes to fulfil its obligations under the guarantee within XX working days of the pool (pool basin) being made available by the Customer to the Guarantor in accordance with point 6 below. The time limit for removal of the defect or rectification of the defect may be extended by XX working days if specialised work has to be undertaken by the Guarantor, of which the Customer will be notified in writing.
  3. In the event that the Guarantor decides that it is unable to repair the damage caused to the pool (pool basin), the Guarantor undertakes to replace the pool (pool basin) with a new, unused product, functionally comparable to the one being replaced. The time limit for replacement will be indicated by the Guarantor in writing to the Customer or will be agreed with the Customer.
  4. If the Guarantor is unable to repair or replace a defective swimming pool (swimming pool basin) covered by the guarantee, in this case it is obliged to pay its equivalent in the amount corresponding to its price at purchase, within a 30-day period from the date of notification to the Customer and transmission in writing by the Customer to the Guarantor of details of the bank account for the transfer of funds.
  5. The Guarantor is not liable for the costs of dismantling or installing the pool (pool basin) and sending it for servicing during the warranty period if the Guarantor did not carry out the complete installation of the pool and the installation was not carried out by pool, heating and plumbing companies.
  6. In the case of pools (swimming pools), the Customer is obliged to prepare the site and the pool for inspection, repair in accordance with the instructions of the Guarantor communicated in response to a guarantee claim. The swimming pool prepared by the customer must be made available in a condition that meets basic hygienic conditions and in a state that allows repairs to be carried out, on pain of the pool being brought up to these requirements at the customer’s expense, who is entitled to the guarantee.
  7. If, in the performance of the guarantee obligations, the guarantor has replaced the pool (pool basin) with a defect-free pool, the guarantee period – respectively – for the pool runs anew from the time of delivery.
  8. The guarantee for swimming pools (pool basins) does not exclude, limit or suspend the Customer’s rights under applicable law. Apart from the liability set out in this guarantee or resulting from mandatory legal provisions, the Guarantor is not liable for any damage caused by defects in the pool (swimming pool basin) or their failure to be rectified on time. Any further liability for indirect and consequential damages and lost profits is excluded.
  9. The guarantor may entrust the guarantee work to specialised service companies.
  10. The warranty is valid from the date of delivery.

MANUFACTURER’S RECOMMENDATIONS

The Manufacturer recommends that the Customer covers the purchased products, in particular the swimming pool (pool basin), products that are connected to or installed in the swimming pool (pool basin) with accessories and swimming pool (pool basin) roofs with an insurance policy from a selected insurance company.
